Refund Policy for OptionsSimulator.com. 14-day cooling-off refund, monthly subscription cancellation, Lifetime plan terms, and step-by-step refund process.
1. Overview
This Refund Policy explains your rights regarding cancellations and refunds for subscription plans purchased on OptionsSimulator.com (the "Service"), operated by Thetix Technologies Ltd, a company incorporated in England and Wales under Company Number 17113756, with its registered office at 2 Frederick Street, Kings Cross, London WC1X 0ND, United Kingdom ("Company", "we", "us", or "our").
This Refund Policy forms part of, and is subject to, our Terms of Service and Payment Terms.
2. Statutory Cooling-Off Period (Right of Withdrawal)
If you are a consumer located in the United Kingdom, the European Economic Area (EEA), or any other jurisdiction that provides a statutory cooling-off or withdrawal period, you have the right to cancel your subscription within 14 days of the initial purchase date without giving any reason.
2.1 How to Exercise Your Right
To exercise your right of withdrawal, you must notify us of your decision by sending a clear, unambiguous statement to:
Email: support@optionssimulator.com
Your cancellation request must include:
- Your full name as registered on your account.
- The email address associated with your account.
- Your subscription plan and the date of purchase.
- A clear statement that you wish to cancel and request a refund under the cooling-off period.
You may also use the following model withdrawal statement (but it is not mandatory):
"I hereby give notice that I withdraw from my contract for the [Basic/Premium/Lifetime] subscription plan on OptionsSimulator.com, purchased on [date]. Name: [your name]. Email: [your email]."
2.2 Refund Processing
Upon receiving a valid cancellation request within the 14-day cooling-off period, we will:
- Acknowledge your request within 2 business days.
- Process the refund without undue delay, and in any event no later than 14 days from the date we are informed of your cancellation decision.
- Issue the refund to the original payment method used for the purchase via Stripe. We do not offer refunds by alternative methods (e.g. bank transfer, credit note, or store credit).
Depending on your bank or card issuer, the refund may take an additional 5–10 business days to appear on your statement after we have initiated it.
2.3 Effect on Access
Upon processing the refund, your subscription will be immediately downgraded to the Free plan. You will retain access to Free plan features but will lose access to any premium features associated with your cancelled subscription.
2.4 Waiver of Cooling-Off Period
If you access or use premium features of the Service during the 14-day cooling-off period, you acknowledge that you have expressly requested the Service to begin during the withdrawal period. In accordance with applicable consumer protection law:
- In the United Kingdom, under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, Regulation 36(1), you may lose your right to cancel to the extent the Service has been provided.
- In the European Union, under Directive 2011/83/EU, Article 16(m), the same principle applies where the consumer has expressly consented and acknowledged the loss of the right of withdrawal.
We will inform you of this waiver before your first use of premium features after purchase.
3. Refunds for Monthly and Annual Subscriptions (Basic and Premium)
3.1 Within the Cooling-Off Period
Full refund as described in Section 2 above.
3.2 After the Cooling-Off Period
Monthly and annual subscriptions are generally non-refundable after the 14-day cooling-off period. When you cancel a subscription, you retain access to premium features until the end of your current billing period (month or year, as applicable), after which your subscription will not renew.
For annual subscriptions, please note that the 14-day cooling-off period runs from the date of the annual payment, not from each monthly anniversary. If you cancel an annual subscription after the cooling-off period, you retain access for the remainder of the paid year but no partial refund is issued for unused months.
3.3 Exceptional Circumstances
We may, at our sole discretion, consider refund requests outside the cooling-off period in the following exceptional circumstances:
- Extended service outage: if the Service is unavailable for a continuous period exceeding 72 hours due to issues within our control, you may request a pro-rata refund or credit for the affected period.
- Billing errors: if you were charged incorrectly (e.g. double charge, wrong amount, charge after cancellation), we will issue a full refund for the erroneous amount.
- Technical issues preventing use: if a persistent, verifiable technical issue prevents you from accessing or using the premium features you paid for, and we are unable to resolve it within a reasonable time, you may be eligible for a pro-rata refund.
To request a refund under exceptional circumstances, please contact support@optionssimulator.com with details of your situation.
4. Refunds for Lifetime Plan
4.1 Within the Cooling-Off Period
The 14-day statutory cooling-off period applies to the Lifetime plan. If you request cancellation within 14 days of purchase, you are entitled to a full refund of $499, subject to the waiver provisions described in Section 2.4.
4.2 After the Cooling-Off Period
The Lifetime plan is non-refundable after the 14-day cooling-off period. The one-time payment grants access to premium features for the operational lifetime of the Service.
4.3 Service Discontinuation
In the event that we permanently discontinue the Service, Lifetime plan holders will be given:
- At least 90 days' advance notice of the planned discontinuation date.
- The opportunity to export any personal data and simulation history.
- A pro-rata refund may be offered at our discretion, calculated from the date of purchase to the discontinuation date, taking into account the total period of service usage. We are not legally obligated to provide such a refund, but we will make commercially reasonable efforts to treat Lifetime plan holders fairly.
5. Free Plan
The Free plan is provided at no cost. No payments are made and therefore no refunds apply.
6. Promotional and Discounted Purchases
If you purchased a subscription at a promotional or discounted price, any refund will be calculated based on the amount actually paid, not the standard price. The same refund eligibility rules apply regardless of whether a promotion or discount was used.
7. Chargebacks
We strongly encourage you to contact us at support@optionssimulator.com to resolve any billing concerns before initiating a chargeback or dispute with your bank or card issuer.
If a chargeback is initiated:
- Your account may be temporarily suspended pending the outcome of the dispute.
- We will provide relevant transaction evidence to Stripe for the dispute process.
- Chargebacks found to be fraudulent may result in permanent account termination.
We aim to resolve all billing disputes within 5 business days when contacted directly.
8. How Refunds Are Processed
All refunds are processed through Stripe and returned to the original payment method. The refund process is as follows:
- Step 1: You submit a refund request to support@optionssimulator.com.
- Step 2: We acknowledge your request within 2 business days and verify eligibility.
- Step 3: If eligible, we initiate the refund through Stripe within 14 days of your request (typically much sooner).
- Step 4: Stripe processes the refund to your original payment method. Depending on your bank or card issuer, the refund may take an additional 5–10 business days to appear on your statement.
Total time from request to refund appearing on your statement: typically 3–15 business days.
9. Non-Refundable Items
The following are not eligible for refunds:
- Subscription fees for billing periods that have already fully elapsed.
- The Lifetime plan after the 14-day cooling-off period.
- Currency conversion fees charged by your bank or card issuer.
- Taxes collected and remitted to tax authorities on your behalf (unless your entire purchase is refunded).
10. Your Consumer Rights
Nothing in this Refund Policy affects your statutory rights as a consumer. If you are located in the United Kingdom, the European Union, or another jurisdiction with mandatory consumer protection laws, your statutory rights take precedence over any conflicting provisions in this policy.
For UK consumers, your rights under the Consumer Rights Act 2015 and the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 are fully preserved.
11. Changes to This Refund Policy
We may update this Refund Policy from time to time. Changes will be posted on this page with an updated "Last updated" date. Material changes that reduce your refund rights will not apply retroactively to purchases made before the change.
